Background

A public prosecution office filed a case against a defendant before the court. The office requested the court to charge the defendant with possessing firearms without a licence.

He said that he has a licence for his firearms and that the other firearms were owned by another person.

Decision

The court considered the documents of the case. The court said that Article 130 of Saudi Arabia Cabinet Decision No. 12/1435 stipulated that the court should consider the cases that fell under its geographical jurisdiction. The court said that the defendant lived in a different place.

The court ruled that the consideration of the case did not fall under the jurisdiction of the court.

The office appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
