SBG 3387/2015
The original dispute involved a request to dismiss an administrative decision on the location of a petrol station. A key point was the claimant had not included the necessary information when filing an adminstrative case.
Background
A claimant filed a case against a defendant before the court. He requested the court to dismiss a decision made by the defendant to establish a petrol station near his home. He also requested the court to order the defendant to pay him a compensation.
Decision
The court considered the documents of the case. The court said that Article 5/1 of the Law of Advocacy stipulated that an administrative case should be made to the relevant court and that it should include the details stipulated by the Law of Advocacy. The court said that Article 41/1 of the Law of Advocacy stipulated that the case should include the name of the claimant and the number of his identity card and his address. The court said that the documents of the case revealed that the claimant had failed to include his address in the case document.
The court dismissed the case.
The court of appeal upheld the ruling.
