SBG 3234/2015
This case involved a property which was being connected by a government department to the sewage network and was seized. A key issue was whether the court had jurisdiction in this case.
Background
A claimant filed a case against the department of water before the court. He said that the department had connected his house to the sewage network which was illegally seized by a third party. He said that he filed a case against the third party and requested the court to order the department to suspend its works until the case was settled.
Decision
The court considered the documents of the case and said that the dispute was related to a property. The court said that the consideration of the case therefore did not fall under the jurisdiction of the Board of Grievance according to Article 21 of the Law of Advocacy.
The court ruled that the consideration of the case did not fall under the jurisdiction of the Board of Grievances.
The claimant appealed the ruling before the court of appeal.
The court dismissed the appeal and upheld the appealed ruling.
