This case involved if the elements existed of the crime of stopping security officers do their job.

Background

The office of the public prosecution filed a case against a defendant before the court. It requested the court to penalize the defendant for using force in order to prevent security officers from doing their job.

Decision

The court considered the documents of the case. The court said that the use of power to prevent public servant from doing his job cannot be validated unless there are two conditions. The first one is using power to acquire illegal benefit and that the second one is using power to make a public servant avoiding the job he should do. The court said that the documents revealed that the defendant did not use the power against the security officers.

The court acquitted the defendant.

The court of appeal upheld the ruling.
