SBG 2963/2015
This case involved an individual who had stopped paying instalments for the purchase of a company because he claimed there had been misrepresentation. A key issue was the length of time after the sale the claim had been made.
Background
The claimant requested a defendant to pay the remaining part of the price of the company which they had purchased under a contract signed between the two parties and the inventory committee record.
The defendant said they had indeed sign a contract with the claimant but they stopped paying the price because they found issues in the contract. The defendant contacted the claimant to reach an amicable solution through an arbitrator but this did not happen. The contract included deceit which had caused the defendant damages.
