SBG 233/2015
This case involved amounts due by an agent who had arranged the manufacturing of gold. The contract was dismissed for violating Islamic Law.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to return 812.6 grams of gold and pay 25535 Riyals for manufacturing the gold.
The defendant claimed that he was a broker between the claimant and the traders in the market. The defendant, however, admitted that he owed the mentioned amounts to the claimant.
Decision
The court considered the case documents and concluded that the signed contract between the two parties violated the rules of the Islamic Law.
The court ruled that the contract should be dismissed and that the defendant should return 812.6 grams of gold to the claimant.
The claimant appealed the ruling before the court of appeal.
The court dismissed the appeal and upheld the appealed ruling.
