This case involved a plea to reconsider a ruling and whether this meant implementation should be suspended.
Background
A defendant filed a plea with the court requesting the reconsideration of a ruling which had been issued in absentia which ordered him to pay to the claimant a specific amount of money.
Decision
The court of first instance issued a ruling accepting the plea against the ruling issued in absentia and the defendant submitted new documents relating to the case and requested that the court suspend the implementation of the ruling issued in absentia.
The court said that it had considered the case and its documents and Article 202 of Saudi Arabia Cabinet Decision No. 11/1435 which provided that submission of a plea does not result in the suspension of the implementation of a ruling, however, the court which was considering the plea can request the suspension of the implementation if it was requested to do so. Given that the request had met all the conditions and that the defendant had submitted new documents the court issued a ruling to suspend the implementation of the ruling issued in absentia and the court of appeal upheld the ruling.
