SBG 1928/2015

This case involved a request by a partner to dissolve a company as there were many disputes between the partners which were damaging the company.

Background

The claimant appealed the ruling before the court of appeal. The court of appeal repealed the ruling and referred the case to the elementary court.

Decision

The elementary court considered the documents of the case. The court said that the documents revealed that many persons had filed cases in order to register themselves as partners in the company. The court said that disputes existed between the partners to prevent the liquidation of the company. The court said that the liquidation wouldresult in the dismissal of the company according to Article 15 of the Law of Companies.

The court dismissed the case.

The court of appeal upheld the ruling.
