SBG 1817/2015

This case involved the jurisdiction of the court over a case involving a man who had fired a machine gun at a wedding. Key issues include which legislation covered the law.

Background

The General Prosecutor “filed a claim against a defendant because he had fired a shot from a machine gun during a wedding. The defendant said during questioning that he had admitted he was the one who had fired the shot from the gun. He was referred to the General Court which issued a Sharia Ruling dismissing the claim by the General Prosecutor because the court did not have jurisdiction and  the jurisdiction was with the Board of Grievances.

The General Prosecutor said the actions of the defendant had been made with full mental capacity and they were actions which were criminalized by the law therefore the General Prosecutor requested the court to reconsider the case.

Decision

The court said the defendant had not attended the court even though he was notified.
