The initial issue was an individual who had been found to have a fire arm and ammunition without having a license. A key issue was the impact if the accused had not been notified of the case in the correct manner.
Background
The General Prosecutor said that a criminal case was against a defendant who had been investigated for possessing a fire arm and 17 bullets. The General Prosecutor said this act is punished by the provisions of Article 4 of the Arms and Ammunition Law therefore the defendant requested to confirm the charge against him and he be punished under Article 40 of the Arms and Ammunition Law because he had no licence to possess these arms. The weapon and the ammunition should also be confiscated under Article 50 of he Arms and Ammunition Law.
It became evident that the defendant was not notified of the case.
