Background

Some heirs stated that the deceased had not got his rights as a partner in the company which was the subject matter of this claim and that he was not given his rights as a manager of the company. They filed the claim to request compensation for the damages they had suffered as a result to being prohibited from taking the rights' as heirs and for payment of the lawyer's fees.

The defendant said that the partnership with the deceased had ended and he submitted a proof of this in the form of minutes of a meeting between him and the deceased person. The contents of the minutes included that the company had been referred for liquidation with an accountant's office and that the decision of that office was binding to both parties. The defendant requested the court to dismiss the case.
