SBG 1208/2015

This case involved a claim by a partner for the court to order he get access to a company's accounts and a profit share. A key point was that the partner had not first followed the official procedures for asking the company to provide access to the accounts before filing the case.

Background

A claimant said that it had been agreed with the defendant to establish a limited liability company however the management of the company did not show any official documents that outlined the profits and losses of the company. He was a partner who owned 255 of the capital and had the right to get annual profits according to the fifth paragraph of the foundation contract. Therefore the claimant requested to view the company statements and accounts and ordered the company to pay the share of the due profits and to rule that the claimant existed in the company which was the subject matter of the company.

It was stated the claim was malicious and there was a request the court to dismiss the ruling.
