This case involved a ruling on returning an individuals share of shares in a company where there was another ruling on the legitimacy of a sale of those shares.
Background
A claimant stated that a ruling had been issued by the commercial court in his favour confirming his 20% share in the defendant company. The court of appeal issued a ruling upholding this ruling.
The defendant company said that it did not have capacity in this case.
The court of first instance said that by examining the documents of the case it had established that the dispute was subject to the Companies Law therefore the Board of Grievances' court had jurisdiction to consider it.
Decision
The final ruling issued by the commercial court, which was upheld by the court of appeal, included two matters first, confirming the correctness of the agreement between the defendant and others, and the second, confirming the right of the claimant to get take back his sold shares.
Under this final ruling, it was not possible to request the claimant's request to register his share in the defendant company until the matter related to the right to return the shares sold to others was decided.
