This case involved whether the crime of forgery existed. A key point was the company owner changed their position to confirm that the individual had been delegated to draft and sign contract on their behalf because the company owner was absent.
Background
The General Prosecutor said that a defendant had forged a contract agreement attributed to a contracting company which committed the company to construct a building worth 400,000 Riyals without the knowledge of the company. The defendant did so by means of crafting and photocopying the contract using a scanner linked to a computer. The prosecutor requested that the defendant be punished pursuant to the provisions of Articles 5, 6 and 9 of the Anti-Forgery Criminal Law.
The defendant denied the charge and said that the contract was correct and was not forged. He said his current sponsor was aware of this and that the sponsor was outside the area at the time of writing the contract therefore he had delegated him to sign the contract on his behalf.
