SASJC 49/3/2000

This case involved title to land which had been seized because of an electricity network. The owners had owned and farmed the land for over 30 years and confirmed they would not interfere with the electricity network. The key question was whether they could be granted title to this land after the orders on compulsory purchase although they had owned the land before those orders.

Background

Some land owners filed a case before Al Afladj court requesting the judge to issue a title deed for the agricultural land they had purchased in 1961, but the electricity company, the department of agriculture, the ministry of petroleum and the patrimonial property of the state department objected to this request because this land involved ARAMCO Seizures.

The land owners stated they were ready not to farm or build around the Electricity network path and added that they had owned the land since 1961 before ARAMCO Seizures existed. A witnesses confirmed that since 1961 the plaintiffs had owned the land which they farmed and on and they had dug many wells.
