SACC 829/1443
The court dismissed a company's request for financial restructuring due to the incomplete and inadequate information provided, including a lack of evidence regarding its assets, enforcement rulings, and creditor details, failing to meet the legal requirements.
Background
A claimant company had filed a claim with the court requesting the beginning of its financial restructuring because it expected that its activities would stop due to its inability to renew its commercial registration due to a number of enforcement decisions filed against the claimant company because of its accumulating debts.
The court stated that Article 47 of Saudi Arabia Cabinet Decision No. 264/1439 stipulated that the court may dismiss such requests in several cases, including if the request had not met the legal requirements or if it was incomplete without a valid reason.
