Background

A debtor filed a request to the court for an extension of the claim’s suspension period for a duration of 180 days, as stipulated by the law in order to settle his financial position. He said that the initial period was nearing its end and he wanted an additional extension to continue his commercial activities and be able to repay the creditors..

The court said that that Article 46 of Saudi Arabia Cabinet Decision No. 264/1439 stipulated that the request for financial restructuring proceedings result in claims against a debtor being suspended for a period of 180 days. The court may extend this period for up to an additional 180 days, either on its own initiative or upon the request of the trustee or the debtor.

Decision

The court said that the case documents revealed that the court had initially determined a 180-day duration for the financial restructuring. However, on realizing the seriousness of the debtor's efforts to resume his commercial activities, the court deemed the requested extension was necessary, as it served the debtor's interests.
