This case involved whether a credit could receive back assets they owned which were in the debtor's possession when there had been a suspension of financial restructuring procedures.

Background

A creditor filed a request with the court seeking the authorisation to recover his equipment, which was in the debtor's possession, after the court had decided to initiate financial restructuring proceedings for the debtor. It was established that the equipment was owned by the creditor based on contracts and agreements concluded with the debtor.

The court said that Article 30 of the Executive Regulations of the Bankruptcy Law stipulated that during the claim’s suspension period, the court would consider the request of a creditor who claimed ownership of assets in the possession of a debtor. The court may order the return of those assets in the following cases: - if the debtor's assets had not changed in terms of an increase, decrease, or modification that altered their nature, if the creditor had not received any part of the payment for the assets, if the creditor had submitted the request within five days from the date of the claim’s suspension.
