Background
A company filed a claim with the court requesting the start of the financial restructuring process because it had accumulated debts due to the economic stagnation and its inability to pay.
The court said that Article 42 of Saudi Arabia Cabinet Decision No. 264/1439 stipulated that a debtor may request the court to carry out financial restructuring procedures if it became insolvent.
The documents of the case showed that the creditor in this claim had applied in the past in a case which was filed before this present claim requesting the liquidation of this company and that that case was still open and had not been adjudicated on therefore the request of the creditor preceded this request of the company.
Decision
The court dismissed the claim.
