Background
A claimant, a sole proprietorship registered under the Ministry of Commerce and Industry, filed a claim for outstanding payments for medical services provided under an agreement with the defendant. The claimant sought to recover SAR 150,060.21, which it alleged was due under the terms of the agreement.
The claimant alleged that the defendant had failed to pay for medical services provided in accordance with their agreement. The claim was not based on an insurance contract but rather a contract for service provision.
The General Secretariat of the Committees contacted the defendant on two separate occasions, requesting a response, but received no reply.
The defendant’s legal representative attended the hearing and argued that the committee lacked jurisdiction over the dispute, as the claim did not arise from an insurance contract.
A hearing was convened, attended by the claimant and the defendant’s legal representative. The claimant reaffirmed the claim, confirming that it was based on a service agreement rather than an insurance contract. The defendant maintained its argument that the committee lacked jurisdiction.
After hearing both parties, the committee closed the hearings and proceeded to deliberate.
