This case involved an insurance claim where an individual had an injury as a result of medical negligence. Issues included whether the claim was covered as the injury had occurred during the policy period but the claim had not been made within the required time.

Background

The plaintiff, an Egyptian national, filed a claim with the General Secretariat of the Committees, stating that he was employed as a General Surgery Consultant at a hospital and was insured under a Medical Malpractice and Third-Party Liability Insurance Policy. The policy covered the period from 14 August 2011, to 13 August 2014.

During a surgical procedure, the patient sustained a burn injury on the inner surface of the right leg due to a thermal cautery device. The injury was treated successfully, and the patient was discharged from the hospital. Subsequently, the Private Health Sector Affairs Department initiated an investigation following the patient’s complaint regarding the medical error.
