This case involved an individual who had been caught in the possession of the drug Khat. The case gives details of the punishment and considered the issue of whether the court had the power to grant the accused's request that they be deported.
Background
On 27/03/2006 the public prosecutor of the Investigation and Public Prosecution Authority claimed before Jizan General Court that an accused person was stopped on 29/01/2006 and upon inspection a green plant suspected to be Khat an (Arabian shrub used as a stimulant) had been found. The suspected material weighed 253 Kg. The material was tested and turned out to be Khat, which is prohibited in Saudi Arabia. The accused person conceded he had transported Khat by a car which belonged to somebody else for an amount of money. The accused person requested the provisions of Article 38 of the Anti-Drugs Law issued issued on 13/08/2005 be applied. He also requested to be deported in line with this law.
