This case involved fines imposed on an importer of fabric who had disposed of the goods before receiving the sample results. The importer tried unsuccessfully to argue the fine should be reduced because he was old, had stopped importing as he could no longer to the necessary administration, the tests were late and the fines were high.
Background
A shipment of fabric was stopped by the Customs Department on behalf of a factory. The Customs submitted samples to the laboratory and the owner of the factory pledged to wait for the tests results before disposing of the goods. The results showed that the samples did not conform to the required specifications. The owner of the factory did not honour his undertaking. The case was then referred to the First Instance customs Committee in Dammam.
The Committee issued a ruling convicting the owner of the company of smuggling and compelled him to pay a customs fine and a forfeiture fee equivalent to the value of the shipment.
