Permission to Appeal - Visa Services - Contract Term - Liquidated Damages - Unrepresented - Evidence - Not at First Instance
This case involved permission to appeal where an amount lower than that detailed in a contract term which applied if a client seeking visa services was unable to obtain the visa because of their own deficiency was awarded. Although it was claimed by the visa services company that they had expenses higher than the awarded amount they had not provided evidence of these at the first instance stage. The fact they had not been represented was also considered.
