Akram Hidri and another v Qatar Financial Centre Authority
This case involved a claim for damages for alleged negligence by the QFCA which it was stated had caused a delay in a share transfer which led to a loss. The key issue was the QFCA's immunity in relation to civil liability in relation to acts, omissions or negligence in the course of performing their duties in good faith. What would constitute bad faith and the approach to summary judgments were also considered.
Background
Some Claimants sought damages from the Defendant on the basis that it was said that the Defendant had negligently delayed processing a 'Controller Notice' in connection with a share transfer, and the delay was said to have caused the Claimants loss. The Claimants also alleged the Defendant had been negligent in failing to intervene in subsequent legal proceedings brought by the Claimant against another company.
