Background
This case involved an application by B to set aside an arbitral award rendered in an ICC arbitration between B and C, arising from a dispute over their joint venture company D. The joint venture had been set up to secure major road construction projects in Qatar.
The request was for an order to set aside the Award because the Award was not in the interest of the QFC’ and/or wass contrary to the public order of the QFC and/or the State of Qatar. ii. Alternatively, they requested an order to set aside the Award because the Arbitration was not conducted in accordance with the Parties’ agreement.
The seat of the Arbitration was the QFC. and the substantive law of the Arbitration was Qatari law.
B had raised four grounds for setting aside the award under Article 41 of QFC Arbitration Regulations 2005.
