The initial dispute involved the breach of a guarantee in a company sales contract. This case involved appropriate costs in the case against the eighth defendant and insurance company which provided professional indemnity insurance to one of the parties. A summary judgment had been dismissed without merit and the eight defendant had also won a seperate disclosure case.
