This case involved costs of the enforcement of a contempt of court order. A key issue was whether indemnity costs should apply.
Background
On 14 February 2024 an Enforcement Judge – Justice Dr Muna Al-Marzouqi – made declarations that the Respondents were in contempt of court for failing to comply with an asset disclosure order and for making various false representations to the Court. The Court imposed a financial penalty of QAR 25,000 on each Respondent by way of sanction. The Court also ordered that the Respondents be jointly and severally liable for the Applicant’s reasonable costs of the contempt application, to be assessed by the registrar if not agreed. The Applicant submitted its costs claim and the Respondents were given an opportunity to respond. In keeping with the conduct of the Respondents throughout the course of this case, they did not acknowledge this let alone file and serve any response.
