This case involved a bonus paid to an employee whose role was scheduled under the nationalisation policy to be filled by a national. The employee had been successfully carrying out his role for several years and getting the top performance grade. He was given a special option to chose to resign or have his employment terminated. During the last few months when the new incumbent was in place he had not come to work but had continued to work. The key issue was a downgrading of his performance to grade 3 with a smaller bonus as he was said to be on garden leave - although the employee had not been told this. Disclosure was also considered.
