Mohammad Amin Hamza v Masters Business Consultancy LLC

This case involved an employee's claim for damages as it was stated their former employer had prevented the transfer of their sponsorship to an new employer, Issues included if the former employer was required to provide a NOC. Also was considered was if the former employer did not have the right to raise objections. In this case the employer had commenced civil and criminal litigation against the employee which was dismissed.

Background

The Claimant, Mr Mohammed Amin Hamza, was a US citizen. The Defendant, Masters Business Consultancy LLC, was an entity established and licenced to do business in the QFC. The parties entered into an employment agreement on 23 August 2023, and that from that date the Claimant was subject to the sponsorship of the Defendant in the State of Qatar. The employment relationship was terminated on 25 October 2023 pursuant to a Termination of Service Agreement and after the termination of his employment relationship with the Defendant, the Claimant sought to transfer his sponsorship to a non-QFC entity, Mavericks Business Consultancy WLL
