The initial dispute involved insurance payments for employees injured in an accident. The key issue was a failure to abide by a court order to disclose the primary insurance policy and an application to strike out the claim. It was not enough to say the documents were irrelevant even if they had been they should have been provided or reasons for not doing so properly explained. Also considered was that the court orders were in English not Arabic.
Background
An Applicant applied for permission to appeal against the decision of the First Instance Circuit to strike out its claim for non-compliance with the directions of the Court, and in particular a direction to disclose documents vital to the Defendant’s case ([2024] QIC (F) 29).
