This case involved unpaid amounts on a bitumen contract which had been ruled on in a summary judgment and permission to appeal that judgment had been refused. A further case had been filed against the company which was a party in the original case and the signatory director. This was declared res judicata and the claimant was instructed if they wished to make a fresh claim against the director.
