The initial dispute had involved a claim involving the breach by former employees and their new employer of non-compete and non-disclosure terms in employment contracts. The former employer had tried to obtain an interim and permanent injunction as well as taking the case. When the interim and permanent injunction request had failed they had withdrawn the case. A key issue was whether they should be treated as the unsuccessful party and required to pay costs of all the defendants.
