Fadi Sabsabi v Devisers Advisory Services LLC
This case involved an appeal of a decision by the court of first instance on a cost order made by the registrar. Both parties had not been represented in the original proceedings. Costs were claimed by the loosing party for legal costs they had spent in having their cost assessment undertaken by a law firm.
Background
In a written application made on 23 March 2023, the Applicant (Devisers) sought permission to appeal from the judgment of the First Instance Circuit on a decision on costs given on 25 January 2023 ([2023] QIC (F) 4). The proceedings were brought by Mr Sabsabi The dispute on costs arose following a decision of the First Instance Circuit on 12 April 2022 ([2022] QIC (F) 5), finding that the Respondent, Mr Sabsabi, was entitled to set aside an agreement dated 16 December 2019 made with Devisers, a company which provided professional consulting services relating to visa applications on the grounds of misrepresentation as to the length of the residency requirements in the UK which were required if Mr Sabsabi and his family would be entitled to apply for UK citizenship.
