Adil Bashir Ahmed v 360 Nautica LLC and 360 Nautica LLC v Adil Bashir Ahmed
This two cases involved a former employee. The first related to non-payment of wages and whether the court had jurisdiction as a previous ruling by the Employment Standards Office had been rejected. However, this was because the party had withdrawn their case. The second involved whether the employee was allowed to operate in a similar area post employment. A letter of undertaking and not the employment included non-compete requirements. However, there involved no solicitation of clients and employees not restricted activities.
Background
The Court directed that these two cases should be heard together. The earlier of these cases was initiated by a claim form dated 17 November 2011. In it the claimant Mr Ahmed, who was not legally represented, described the defendant as Tejinder Singh Hardev Singh (360 Nautica), although it was plain from the other terms of that form that the action was directed not against any individual but against 360 Nautica LLC, a corporate body established in the Qatar Financial Centre (QFC). When a defence was subsequently filed to that claim form, it was in the name of 360 Nautica LLC.
