This case involved a request for summary judgment where an employee whose employment had been terminated had asked there former employer to provide a non-objection certificate (NOCs) so they could transfer their sponsorship to a new employer. NOCs were generally no longer required but as it was said the employer had previously objected to this employee's transfer the Ministry had asked for one. The NOC had been issued but the request for the employer also to provide their computer card to validate it had been refused. As a result the NOC had expired as had the employee's identity card meaning they could not transfer to the new employer and had been fined. A new NOC, validation with the card and payment of fines were requested along with compensation. Summary judgment was granted on all the requests except for the compensation which was to be heard at full trial. Procedural failings in the application for the summary judgment were also raised.
