Business Box Consultancy LLC v Abdulla Darwish Fakhro

This case involved a claim and counter claim for an unpaid amount agreed to be paid for a feasibility study which was to be used to support a financing request to a bank for a copper project. The final feasability study had concluded that the project was not feasible and the bank refused to finance it. As a result the customer had refused to pay the outstanding amounts as they claimed the report had not been fit for purpose. Other issues had included the court's jurisdiction to hear the dispute and there had been proceedings taken and rejected in the Qatari onshore courts too. One of the issue was whether this court could rule on expenses for legal proceedings at both courts. Other issues included the status of a confidentiality clause and interest.
