This case involved whether the QICDRC court had jurisdiction to rule on interim relief and precautionary measures in a dispute involving two companies which were not established in the QICDRC but whose contract provided for the seat of arbitration to be there.
Background
This Court of First Instance Note issued a note following a ruling on an application to the Court for an injunction in connection with an arbitration. This Note dealt solely with the issue of jurisdiction. Since the matter related to an arbitration, the Court anonymised the names of the parties.
C, was a company which was not established within the Qatar Financial Centre (QFC), and it entered into a contract with D, which was also a company not established in the QFC. The contract provided for LCIA arbitration and stated that “The seat of the arbitration be the Qatar International Court and Dispute Resolution Centre (QICDRC) in the Qatar Financial Centre, Qatar (QFC) and the venue of the arbitration shall be Qatar”.
C applied to the Court for interim relief/precautionary measures in relation to the contract by way of an injunction maintaining the status quo pending determination of the dispute.
