This case involved payment under a consultancy agreement where there was a guarantor. The agreement had come about after a loan had been made to a shareholder for the company which was intended to be covered by the company.. After the cancellation of the security cheque covering that initial agreement. The parties had agreed so has not to impact their capital adequacy this consultancy agreement would be put in place between the company and Ms Richards to enable the payment of the moment by instalments with post dated cheques. A key issue was whether this was a fictitious contract and if the parties had been forced into signing under duress. Also considered was the status of the guarantor and if it was covered by the Qatari Civil Code or QFC Contract Regulations as it was merely subject to Qatari law.
