This case involved the cost awards in a case where an unsuccessful claimant was a self representing employee and the defendant had used internal inhouse counsel and counsel from abroad.

Background

On 24 January 2019 the Appellant Division issued a judgment on costs following an earlier judgment where an applicant seeking permission to appeal a decision of the court of first instance was refused but was allowed to appeal a regulatory tribunal decision. The judgment awarded costs related to the court of first instance but the second respondent did not ask for costs and there were no costs for the proceedings before the appellate division.

The parties were unable to reach an agreement on costs. A request of costs of 8232.75 Riyals was requested of which 34,177.50 Riyals was counsel fees and 64,055.25 Riyals for QFC fees. As the parties were unable to agree a cost assessment was ordered to be provided in paper.

The principles followed in Hammad Shawbkeh v Daman Health Insurance QFC No. 001/2017 on costs are followed on reasonable costs.
