This case involved the criteria used to assess the reasonableness of costs awarded in a case involving action against an appeal request by an employer who owed an employee salary and insurance costs.

Background

On 18 March 2019 the Appellate Division of the Court issued a judgment dismissing an application seeking permission to appeal a decision by the QFC Regulatory Tribunal which had itself dismissed an appeal by the brought by the applicant against a decision by the respondent.

The judgement ordered the applicant pay reasonable costs of the respondent and the interested party for the application seeking permission to appeal.

The parties were unable to reach an agreement on those costs.

The parties were provided directions on cost submissions and the respondent and interested party filed and served a schedule of costs. The applicant sought an extension which was granted but did not provide a submission, so a cost assessment was made without their submission.
