Background
The claimant was a company that operated under the laws and regulations of the QFC. It had employed the defendant as the head of its sales unit. The claimant issued proceedings alleging that the defendant was in breach of the restrictions on competition and solicitation for one year after the termination of his employment contrary to his contract of employment and sought consensual damages under the QFC Contract Regulations. A preliminary issue arose regarding the applicable law of the contract. The Court held, on 29 April 2014, that the QFC Employment Regulations applied to the employment of persons by QFC entities to the exclusion of non-QFC law. The defendant, in support of his defence and counterclaim, sought to rely on non-QFC authorities, namely, case law from England and Wales. The claimant submitted that the Court should dismiss and deem irrelevant those authorities.
