Background
The claimant was a company that operated under the laws and regulations of the QFC. It had employed the defendant as the head of its sales unit. The claimant issued proceedings alleging that the defendant was in breach of the restrictions on competition and solicitation for one year after the termination of his employment contrary to cl 5.2 of his contract of employment (the contract). The defendant contended that the contract had not modified the terms of the claimant's offer of employment to him, which had not contained a non-competition clause. Therefore, the contract should have been considered void as his agreement to its terms and conditions had been due to coercion or bad faith on the part of the claimant. In any event, he contended, cl 5.2 was invalid as an unlawful restraint on his freedom.
