Peter Kuncewicz and Others v Employment Standards Office and Ooredoo Group LLC
This appeal was brought following a decision of 24 July 2017 in which the Employment Standards Office had no jurisdiction to hear a complaint that there had been a breach of the QFC Employment Regulations 2006.
Background
The appellants were former employees of a company called Ooredoo Group LLC (which was previously known as Otel International LLC) which were joined to the proceedings.
It was claimed the company had failed to pay the employees an award under a longterm incentive plan for 2014. They had also miscalculated amounts due under this plan for 2013 and 2015.
The plan was approved by the company defined as Ooredoo Group LLC (also known as Otel International LLC) and at the time of the Employment Standards Office decision was called Ooredoo QSC. That company had a number of subsidiaries including the interested party.
Any participant in the plan was entitled to receive a cash equivalent to the market value of a certain number of shares in the parent company at a future date.
