OSC 101/2018

This case involved compensation which should be paid by an insurance company for injuries an individual had had in a road traffic accident. Issues included whether all the injuries and loss of benefit had been properly considered when assessing the compensation.

Background

A Claimant was involved in a traffic accident which had involved a car insured by the Defendant company, and they sought compensation of 20,550 Rials, ;legal fees and costs. The Claimant had sustained a number of injuries as a result of the accident, and the car, was insured by the Defendant company

.The court held the Defendant was liable for pay damages for injuries which had resulted only from the road traffic accident. The Defendant was obliged to pay 4,750 Rials, legal fees and costs. The Claimant appealed to the Court of Appeal, which formally accepted the appeal but substantively rejected it, and ordered the appellant to pay the costs.
