OSC 16/2006

This case involved unpaid goods by a company. The legal representative or one of the partners in the company should have been informed about the case. However, only the minor son of one of the company owner had been notified so notification requirements had not been met.

Background

A company filed a case against another company before the court requesting the company to pay 13000 Rials. The company said that it had supplied the company with stationery materials but they failed to pay for them.

The court ruled that the company should pay the company the amount.

The company appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling. The court said that the company had failed to file the appeal within the legal deadline.

Decision

The company appealed the ruling before the Supreme Court and said in its grounds of appeal that the ruling had erred in the application of law and that the court had failed to inform it of the case document under Article 13 of the Law of Civil and Commercial Proceedings.
