KCC 699/2018

This case involved the validity of a tenancy agreement for a property in a market and the eviction of tenant. A key issue was there was now a new investor in the market under a public private partnership and whether tenancies signed with the previous investor were still valid.

Background

A company filed a case against a tenant before the court. The company requested the court to order the tenant to vacate a rented property and pay the outstanding rent until the vacation date. The company said that the Ministry of Finance had assigned them to manage the market in which the rented property was located. The company said that the tenant had seized the property and failed to return it to the company without legal justification.

The court ruled that the tenant should vacate the rented property. The court also ruled that the tenant should pay 600 Dinars per month starting from 01/03/2017 until the vacation.

The tenant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and the case altogether.
