This case involved a power of attorney which had authorised an agent to buy property for the principal but the agent had failed to register half the property in the principal's name as agreed.
Background
A claimant filed a case against a defendant before the court. They requested the court to invalidate the registration of half of a property under the name of the defendant and to remove them from the registration record. They also requested the court to validate their ownership of the disputed property. They requested the court to refer the case to investigation to prove an oral agreement held between the two parties in which the defendant had agreed to buy the disputed property for them with the maintenance of the claimant's right for compensation. They said that they had assigned the defendant to buy the disputed property through a general power of attorney, but the defendant had failed to commit and to register half of the property under theirname.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
