KCC 640/2020
This case involved compensation for damage to vehicles in car accidents. The key issue was the evidential value of what were said to be photocopies which were not in Arabic. The evidential value of commercial books which were print outs from accounting records was discussed.
Background
A company filed a case against a company before the court. The company requested the court order the other company to pay 101610 Dinars. The company said that the other company owed the amount as a result of compensation for car accidents. The company said that the cars’ owners had assigned them to claim their rights from the other company. The company said that the other company was responsible for damages which had resulted from the accidents and that they had received the relevant documents. The company said that they had requested the other company to pay the amount, but they had failed to do so.
The court appointed an expert and when he presented his report, the court ruled that the other company should pay the company 79440 Dinars.
The other company appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
