KCC 498/2020
This case involved if the department of judicial fees had the right to order a claimant to pay judicial fees when the court had not ordered him to pay the case expenses when it suspended the consideration of the case until an appeal was settled.
Background
A claimant filed a case against the department of judicial fees before the court. He made a plea against an order on fee estimation and requested the court to dismiss the executive deed and the order. He said that the department had ordered him to pay the judicial fees because the court had suspended the settlement of an appeal and the defendant in that case had paid the judicial fees for him.
The court accepted the plea made by the claimant and dismissed the fees order.
The department of judicial fees appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the plea made by the claimant as well.
